Too fair or too far? The age of the Digital Fairness Act
Context
The European Commission has announced it would propose a Digital Fairness Act (DFA) during the 2024-2029 mandate. The law aims to address critical gaps in the EU’s tech policy framework, focusing on areas like targeted advertising, addictive design practices, and dark patterns. This upcoming legislation, partly influenced by the EU’s fitness check for consumer law, will have significant implications for businesses, particularly startups that rely on digital marketing.
Though the consultation regarding the DFA has not yet been opened, the new law is expected to address unfair practices, level the digital playing field, and ensure that consumers are protected both online and offline. However, as fairness takes the spotlight, how would stricter rules on digital practices impact industries that rely on flexibility for growth?
