CONSENT AND RELEASE
By providing my information and attending the above-referenced event I agree that Setpoint Technologies Inc. and its affiliates (collectively, “Setpoint”) may use a photo, image, audio recording, video or other related media that includes my voice and likeness (collectively, “Media”). I represent that I am 18 years of age or older and fully authorized to provide my irrevocable and unrestricted right to grant Setpoint the rights described herein.
I hereby grant to Setpoint, its agents, employees, licensees, and successors in interest (collectively, the "Released Party") all ownership rights and the absolute and irrevocable right and permission to copyright, use and publish the Media that has been (or is being) obtained pursuant to this Consent and Release.
The Media may be copyrighted, edited, exhibited, distributed, used and/or published or in conjunction with other media and in any medium (including without limitation, print publications, public broadcast, photography or video works, internet, tv, radio) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication. I agree that all Media are and shall remain the property of Setpoint.
I waive any right that I may have to inspect or approve the Released Party's use of the Media, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Media. I release the Released Party (and all persons acting under its permission or authority) from all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the Media (collectively, "Claims"). This release includes without limitation any Claims related to blurring, distortion, alteration, optical illusion, digital alteration, use in composite form, whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication of the Media.
Any claims or actions arising out of or in connection with this Consent and Release shall be brought exclusively in the courts located in New York County, New York. This Consent and Release shall be construed in accordance with the laws of the State of New York without regard to the conflicts of law provisions thereof.
